This Master Disclaimer of Liability and Strict Assumption of Risk (the “Disclaimer”) constitutes a legally binding agreement between you, whether personally or on behalf of an entity (“You”, “Your”, or “User”), and Wiztaqnia (“Company,” “We,” “Us,” or “Our”), a dual-purpose technology media publication and e-commerce entity operating from its registered principal address at  Bangalore, Karnataka, India.

This Disclaimer comprehensively governs your access to, browsing of, and use of the Wiztaqnia website, including all digital media, educational blogs, code repositories, hardware schematics, and the e-commerce storefront for refurbished electronics (collectively, the “Platform”).

BY ACCESSING, BROWSING, OR USING THE PLATFORM, PURCHASING PRODUCTS, OR EXECUTING ANY SOFTWARE OR HARDWARE TUTORIALS PROVIDED HEREIN, YOU EXPLICITLY, VOLUNTARILY, AND UNCONDITIONALLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND UNEQUIVOCALLY AGREE TO BE BOUND BY THIS DISCLAIMER IN ITS ENTIRETY. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND MUST DISCONTINUE USE IMMEDIATELY.

2. GENERAL “AS-IS” AND “AS-AVAILABLE” PROVISION

2.1 No Warranties of Any Kind

All content, products, tutorials, code snippets, architectural diagrams, and services provided on the Wiztaqnia Platform are offered strictly on an “AS-IS” and “AS-AVAILABLE” basis. Wiztaqnia, alongside its founders, authors, guest contributors, and affiliates, makes no representations, warranties, guarantees, or endorsements of any kind, whether express, implied, statutory, or otherwise.

2.2 Explicit Disclaimer of Implied Warranties

To the absolute maximum extent permitted by applicable global laws (including consumer protection statutes under Indian Law, the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA)), we expressly disclaim all implied warranties, including but not limited to:

  • Warranties of merchantability, satisfactory quality, or fitness for a particular purpose.
  • Warranties of non-infringement of third-party intellectual property or proprietary rights.

  • Pre-Owned Status: You expressly acknowledge that all physical products sold are not factory-new. They have been previously utilized and may exhibit cosmetic blemishes, minor wear, physical abrasions, or residual solder. These cosmetic factors do not constitute defects.
  • No Manufacturer Liability: Wiztaqnia is NOT the original equipment manufacturer (OEM) of these items. We strictly disclaim any liability for inherent manufacturing defects, design flaws, or long-term product durability.
  • End-Use Liability: Wiztaqnia exercises no control over how you deploy or integrate the components purchased from our store. We disclaim all liability for any damages, injuries, or system failures resulting from your integration of our refurbished parts into your personal, commercial, or industrial projects.
  • Third-Party Logistics: Physical delivery is facilitated by independent third-party couriers. We completely disclaim all liability for damages incurred during transit, lost freight, or delivery delays caused by external logistics networks or force majeure events.

4. STRICT ASSUMPTION OF RISK: HARDWARE AND ELECTRONICS (“HOMEBREW ELECTRONICS”)

The tutorials, schematics, and instructional guides published under the “Homebrew electronics” section involve direct physical interaction with bare electrical components, soldering irons, microcontrollers, mains electricity, and potentially hazardous chemical materials. These guides are for theoretical and educational demonstration purposes only.

4.1 Unconditional Assumption of Severe Risk

By engaging in, replicating, testing, or modifying any hardware project described on our Platform, you explicitly acknowledge and agree that you are doing so entirely voluntarily and at your own absolute, unmitigated risk. Working with raw electronics poses severe, inherent, and potentially fatal risks. Wiztaqnia, its authors, and its affiliates hold ZERO liability for the following occurrences:

  • Lethal Electrocution: Exposure to live electrical currents leading to nerve damage, severe physical injury, or death.
  • Fire, Explosion, and Property Damage: Short-circuiting batteries (especially volatile Lithium-Ion/Lithium-Polymer chemistries), overloading capacitors, or improper circuit wiring leading to structural fires, chemical burns, explosions, or the catastrophic destruction of personal or third-party property.
  • Toxic Exposure: Inhalation of highly toxic fumes released during soldering, the melting of plastics, or component combustion.

4.2 Voided Warranties

Modifying consumer electronics, opening sealed OEM casings, bypassing manufacturer safety protocols, or flashing custom firmware based on our tutorials will unequivocally void the original manufacturer’s warranty. Wiztaqnia accepts no liability for the financial loss of voided warranties, “bricked” hardware, or ruined devices.

4.3 Legal, Safety, and Code Compliance

You are solely, exclusively, and legally responsible for ensuring that your DIY electronic builds comply with all local, state, and national electrical codes, safety regulations, and telecommunications laws (including, but not limited to, FCC or local regulatory standards for radio-frequency emitting devices). Wiztaqnia assumes no liability for regulatory fines, legal penalties, or civil damages incurred by your failure to adhere to such laws.

5. STRICT ASSUMPTION OF RISK: SOFTWARE AND CODING (“HEARTFELT CODING”)

The code snippets, scripts, firmware files, and software architecture tutorials provided in the “Heartfelt Coding” section are highly experimental, provided without continuous maintenance, and designed strictly for isolated educational environments.

5.1 System Integrity and Catastrophic Data Loss

Executing foreign, experimental, or open-source code carries substantial, catastrophic risk. Wiztaqnia, its authors, and its guest contributors are NOT LIABLE for:

  • Operating system crashes, kernel panics, endless boot loops, or irreversible hardware corruption.
  • The complete or partial loss, corruption, encryption (e.g., accidental ransomware triggering), or accidental deletion of personal, corporate, or third-party data.
  • Network vulnerabilities introduced into your architecture, including backdoor exploits, malware susceptibility, API key exposure, or unauthorized third-party access resulting from following our network or server configurations.

5.2 Strict Operational Recommendations

You are strongly and expressly advised to run all provided code exclusively in isolated virtual machines (VMs), containerized sandboxed environments, or on dedicated offline development boards physically separated from your primary production networks. Failure to utilize standard cybersecurity isolation protocols constitutes gross negligence on your part.

6. MEDIA, EDITORIAL CONTENT, AND “NO-NONSENSE TECH”

6.1 No Professional Advice

The information, articles, technical insights, and commentary contained in the “No-Nonsense Tech” section, and across the Platform generally, represent the independent personal opinions, theories, and research of the respective authors.

THIS CONTENT DOES NOT CONSTITUTE, NOR SHOULD IT BE RELIED UPON AS, PROFESSIONAL ENGINEERING, COMPUTER SCIENCE, LEGAL, FINANCIAL, CYBERSECURITY, OR SAFETY ADVICE.

6.2 No Endorsement

Reference to any specific commercial product, process, third-party software library, or service by trade name, trademark, manufacturer, or otherwise, does not constitute or imply its endorsement, recommendation, favoring, or safety verification by Wiztaqnia.

7. GLOBAL LIMITATION OF LIABILITY AND FINANCIAL CAP

TO THE ABSOLUTE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WIZTAQNIA, ITS FOUNDERS, DIRECTORS, EMPLOYEES, GUEST AUTHORS, AFFILIATES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. This comprehensive limitation of liability applies regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise) and includes, without limitation:

  • Damages for loss of profits, goodwill, data, business interruption, or other intangible losses.
  • Damages resulting from personal physical injury, death, or property destruction related to the replication of hardware tutorials.
  • Damages resulting from hacking, data breaches, or third-party service downtime (e.g., payment gateways or logistics networks).

ABSOLUTE LIABILITY CAP: Notwithstanding anything to the contrary contained herein, our total aggregate liability to you for any claim arising out of your use of the Platform, the application of our technical tutorials, or the purchase of our products shall at all times be strictly limited to the actual amount paid by you to us for the specific transaction giving rise to the claim, or INR 1,000 (One Thousand Indian Rupees), whichever is lesser.

8. STRICT INDEMNIFICATION

You agree to unconditionally defend, indemnify, and hold harmless Wiztaqnia, its affiliates, authors, and respective officers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to exhaustive attorney’s fees and court costs) arising from:

  1. Your use of, access to, or inability to use the Platform.
  2. Your direct or indirect implementation of our hardware schematics or software coding tutorials resulting in injury, data loss, or property damage to yourself or any third party.
  3. Your violation of any term of this Disclaimer or our Master Terms and Conditions.
  4. Your violation of any applicable local, state, or international laws in connection with your use of the Platform.

9. GOVERNING LAW, ARBITRATION, AND CLASS ACTION WAIVER

9.1 Governing Law

This Disclaimer shall be governed by and construed in absolute accordance with the laws of India, without regard to its conflict of law principles.

9.2 Exclusive Jurisdiction and Arbitration

Any legal actions, controversies, or disputes arising from this document or your use of the Platform shall be finally and exclusively resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India. The seat and exclusive venue of the arbitration, and any subsequent judicial proceedings, shall be the competent courts located in Bangalore, Karnataka, India.

9.3 Class Action Waiver

You unequivocally agree that any arbitration or legal proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or brought in a purported representative capacity on behalf of the general public.

10. SEVERABILITY

If any provision of this Disclaimer is found to be unenforceable, invalid, or illegal under any applicable law by a court of competent jurisdiction, such unenforceability or invalidity shall not render this Disclaimer unenforceable or invalid as a whole. Such provisions shall be modified to reflect the original intent or deleted without affecting the legal enforceability of the remaining provisions herein.
